Décision
Résumé des faits
1 Par une demande qui s’est vu attribuer la date de dépôt du 26 mai 2014, ECOLAB
ENERGIES (ci-après, « la demanderesse ») a sollicité l’enregistrement de la
marque verbale
OASIS
pour, après modification, les produits suivants :
Classe 7 - Eoliennes de pompage non électriques.
2 La demande a été publiée le 10 juillet 2014.
3 Le 10 octobre 2014, Ecolab USA Inc. (ci-après, « l’opposante ») a formé
opposition à l’encontre de la marque demandée pour tous les produits mentionnés
ci-dessus.
4 L’opposition était fondée sur les dispositions de l’article 8, paragraphe 1, points a)
et b) du RMUE.
5 L’opposition était fondée sur le droit antérieur suivant :
– La marque verbale internationale nº 1 102 057 OASIS désignant l’Union
européenne, déposée et enregistrée le 5 novembre 2011, entre autres, pour les
produits suivants :
Classe 9 - Appareils et instruments de mesurage, de contrôle [inspection]; appareils et
instruments de conduction, distribution, transformation, accumulation, régulation ou
commande du courant électrique.
6 Le 1

mars 2017, la division d’opposition a rendu une décision (« la décision
attaquée »), rejetant l’as amended dans son intégralité. La division d’opposition a
considéré que les « éoliennes de pompage non électriques » ne présentent aucune
similarité avec les « appareils et instruments de mesurage, de contrôle [inspection];
appareils et instruments de conduction, distribution, transformation, accumulation,
régulation ou commande du courant électrique ».
7 Le 28 avril 2017, l’opposante a formé un recours à l’encontre de la décision
attaquée. Elle sollicite l’annulation de celle-ci dans la mesure où l’opposition a été
rejetée. Le mémoire exposant les motifs du recours a été reçu le 3 juillet 2017.
8 Dans ses observations en réponse reçues le 14 septembre 2017, la
demanderesse demande à la chambre de rejeter le recours et de confirmer la
décision attaquée.

Moyens et arguments des parties
9 Pour l’essentiel, l’opposante soutient que les produits au cœur des débats sont
similaires. A cet égard, elle ajoute que les « éoliennes de pompage non
électriques » sont équipées d’appareils pour la mesure et le stockage d’eau,
notamment des « appareils et instruments de mesurage, de contrôle [inspection];
appareils et instruments de conduction, distribution, transformation, accumulation,
régulation ou commande du courant électrique ». Elle soutient ainsi que les
produits sont nécessairement complémentaires.
10 La demanderesse, dans ses observations en réponse, sollicite que le recours soit
rejeté et que la décision attaquée soit confirmée et conclut à la condamnation de
l’opposante aux frais et dépens.
Motifs de la décision
11 Toute référence faite dans la présente décision est au RMUE 2017/1001 (J.O. L
154, 16.6.2017, p. 1) qui a codifié le RMUE 207/2009 tel que modifié, sauf si la
décision en fait une exception spécifique.
12 Le recours est conforme aux articles 66, 67 et 68, paragraphe 1 du RMUE. Il est
dès lors recevable.
13 Le recours soulève uniquement la question de la similarité ou de l’absence de
similarité des produits faisant l’objet des présents débats.
Comparaison des produits
14 Les produits, objets du présent recours, sont les suivants :
Classe 7 - Eoliennes de pompage non électriques.
15 La marque antérieure est enregistrée, entre autres, pour les produits suivants :
Classe 9 - Appareils et instruments de mesurage, de contrôle [inspection]; appareils et
instruments de conduction, distribution, transformation, accumulation, régulation ou commande
du courant électrique.
16 Les éoliennes de pompage non électriques ont pour fonction le pompage d’eau.
Elles sont notamment utilisées à des fins agricoles (irrigation des cultures),
l’asséchement des marais et la constitution de réserve d’eau. Elles transforment
l'énergie cinétique du vent en énergie mécanique et, par définition, ne recourent
pas à l’énergie électrique. Il convient donc de conclure que, de par leur nature,
elles ne présentent aucune similarité avec les appareils et instruments de
conduction, distribution, transformation, accumulation, régulation ou commande
du courant électrique. Dans ses écritures, l’opposante soutient qu’il est possible de
combiner les éoliennes de pompage non électriques avec un générateur afin de
maintenir les activités de pompage les jours sans vent. Dans cette hypothèse, il ne
s’agirait plus d’une éolienne de pompage non électrique mais d’une éolienne
hybride. Mais plus encore, en fait, il ne s’agit pas d’une combinaison mais bien de
l’installation d’un générateur de courant pour charger des batteries. Ce générateur
et ses batteries sont fabriqués par des tiers et distribués sous leurs propres
marques.

17 Demeurent les « appareils et instruments de mesurage, de contrôle [inspection] »
couverts par la marque antérieure. L’opposante déclare que les produits sont
complémentaires puisqu’« il est possible de compléter les pompes mécaniques
mentionnées par des accessoires appropriés pour lesquels la marque de
l’opposante bénéficie d’une protection pour réguler ou optimiser les opérations de
pompage afin d’obtenir, par exemple, un contrôle approprié de la performance ».
Si cette affirmation doit être comprise comme signifiant que les produits couverts
par la marque antérieure sont destinés à être intégrés dans ceux de la
demanderesse, ceci aurait pour conséquence que les produits de l’opposante
seraient vendus aux fabricants des éoliennes de pompage tels que la demanderesse,
alors que ceux de la demanderesse seraient vendus à d’autres consommateurs,
notamment des entreprises agricoles.
18 Or, la définition jurisprudentielle de la complémentarité entre des produits ou des
services induit que les produits complémentaires soient susceptibles d’être utilisés
ensemble, ce qui présuppose qu’ils soient adressés au même public, ce qui n’est
pas le cas en l’espèce (16/05/2013, T-80/11, Ridge Wood, EU:T:2013:251, § 29).
19 Par ailleurs, le simple fait qu’un produit donné soit utilisé comme pièce,
équipement ou composant d’un autre n’est pas suffisant en soi pour conclure que
les produits finaux, englobant ces composants, sont similaires, car notamment,
leur nature, leur destination et les clients concernés peuvent être tout à fait
différents (27/10/2005, T-336/03, Mobilix, EU:T:2005:379, § 61).
20 La mise en œuvre de l’article 8, paragraphe 1, point b) du RMUE présuppose une
identité ou une similitude entre les produits ou les services désignés
(09/03/2007, C-196/06, Comp USA, EU:C:2007:159, § 24). Cette
similarité faisant défaut en l’espèce, le recours est rejeté.
Frais
21 Conformément à l’article 109, paragraphe 1, du RMUE et à l’article 18 du
REMUE, l’opposante, en tant que partie perdante dans la procédure de recours,
supporte les frais exposés par la demanderesse dans la procédure de recours.
22 En ce qui concerne la procédure de recours, les frais comprennent seulement les
frais de représentation professionnelle de la demanderesse à hauteur de 550 EUR.
23 En ce qui concerne la procédure d’opposition, la division d’opposition a
condamné l’opposante à supporter les frais de représentation professionnelle de la
demanderesse pour un montant de 300 EUR. Cette décision reste inchangée. Le
montant total pour les deux procédures s’élève à 850 EUR.

Dispositif
Par ces motifs,
LA CHAMBRE
1. Rejette le recours ;
2. Condamne l’opposante à supporter les frais exposés par la demanderesse aux
fins des procédures de recours et d’opposition pour un montant total de
850 EUR.
