The Office raised an objection on 29/07/2015 pursuant to Article 7(1) CTMR because it found that the trade mark applied for is descriptive and devoid of any distinctive character, for the reasons set out in the attached letter.
The applicant failed to submit observations within the time limit. For the reasons set out in the letter of objection, and pursuant to Article 7(1) CTMR, the application for
Community trade mark No 14 392 922 is hereby rejected for the following services:

Class 39 Boat storage; Boathouse services; Harboring services for ships and boats; Marina services; Marina services [berthing, mooring, storage]; Marina services [docking services]; Parking of boats; Provision of berthing facilities; Provision of information relating to moorings; Slipping of boats; Slipping of yachts.
Class 45 Legal services
The application is accepted for the remaining goods and services, namely:
Class 9 Diving equipment; Navigation, guidance, tracking, targeting and map making devices; Safety, security, protection and signalling devices.
Class 12 Water vehicles; Amphibious vehicles; Vehicles for locomotion by land, air, water or rail; Wind powered vehicles.
Class 35 Advertising, marketing and promotional services; Business analysis and research services; Commercial trading.
Class 36 Banking; Fundraising and sponsorship; Provision of prepaid cards and tokens.
According to Article 59 CTMR, you have a right to appeal this decision. According to
Article 60 CTMR, notice of appeal must be filed in writing with the Office within two months of the date of notification of this decision. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 800 has been paid.
