2. European Union trade mark application No 16 507 006 is rejected for all the above goods. It may proceed for the remaining goods.

PRELIMINARY REMARK


As from 01/10/2017, Regulation (EC) No 207/2009 and Regulation (EC) No 2868/95 have been repealed and replaced by Regulation (EU) 2017/1001 (codification), Delegated Regulation (EU) 2017/1430 and Implementing Regulation (EU) 2017/1431, subject to certain transitional provisions. Further, as from 14/05/2018, Delegated Regulation (EU) 2017/1430 and Implementing Regulation (EU) 2017/1431 have been codified and repealed by Delegated Regulation (EU) 2018/625 and Implementing Regulation (EU) 2018/626. All the references in this decision to the EUTMR, EUTMDR and EUTMIR should be understood as references to the Regulations currently in force, except where expressly indicated otherwise.



REASONS


The opponent filed an opposition against all the goods of European Union trade mark application No 16 507 006 for the word mark ‘STIER’. The opposition is based on Romanian trade mark registration No 68 433 for the figurative mark . The opponent invoked Article 8(1)(b) EUTMR and Article 8(5) EUTMR.



PROOF OF USE


In accordance with Article 42(2) and (3) EUTMR (in the version in force at the time of filing of the opposition, now Article 47(2) and (3) EUTMR), if the applicant so requests, the opponent must furnish proof that, during the five-year period preceding the date of publication of the contested trade mark, the earlier trade mark has been put to genuine use in the territories in which it is protected in connection with the goods or services for which it is registered and which the opponent cites as justification for its opposition, or that there are proper reasons for non-use. The earlier mark is subject to the use obligation if, at that date, it has been registered for at least five years.


The same provision states that, in the absence of such proof, the opposition will be rejected.


On 29/03/2018, the applicant submitted a request for proof of use. However, the request was not filed by way of a separate document as required by Article 10(1) EUTMDR. Therefore, the request for proof of use is inadmissible pursuant to Article 10(1) EUTMDR.



LIKELIHOOD OF CONFUSION — ARTICLE 8(1)(b) EUTMR


A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings. Whether a likelihood of confusion exists depends on the appreciation in a global assessment of several factors, which are interdependent. These factors include the similarity of the signs, the similarity of the goods and services, the distinctiveness of the earlier mark, the distinctive and dominant elements of the conflicting signs, and the relevant public.



  1. The goods and services


The earlier Romanian trade mark No 68 433 is registered for the entire class headings of Classes 20, 35 and 42 of the Nice Classification. It was filed on 22/09/2005. Since the opponent indicated in the opposition notice that the opposition is based only on part of the goods and services, the Opposition Division considers that the scope of protection for the goods and services listed in the notice of opposition is limited to their literal meaning, namely the natural and usual meaning of the general indications in the headings.


The goods and services on which the opposition is based are the following:

As a preliminary remark, it is to be noted that according to Article 33(7) EUTMR, goods or services are not regarded as being similar to or dissimilar from each other on the ground that they appear in the same or different classes under the Nice Classification.


The relevant factors relating to the comparison of the goods or services include, inter alia, the nature and purpose of the goods or services, the distribution channels, the sales outlets, the producers, the method of use and whether they are in competition with each other or complementary to each other.


Contested goods in Classes 1, 2, 3, 4, 7, 8, 9, 11, 12, 16, 17, 18, 19, 21, 22 and 25


The contested goods in Class 1 are essentially chemical substances and preparations, filtering materials, putties, and fillers and pastes for use in industry, natural elements for use in industry, and adhesives and starches for use in industry. The contested goods in Class 2 are essentially coatings, dyes, colorants, pigments, inks, thinners and thickeners for coatings, dyes and inks, and raw natural resins. The contested goods in Class 3 are essentially cleaning, bleaching, polishing and abrasive preparations. The contested goods in Class 4 are essentially fuels, illuminants, dust-controlling compositions, lubricants and industrial greases, waxes and fluids. The contested goods in Class 7 are essentially machines, machine tools, engines, powertrains, and controls for the operation of machines and engines and their parts. The contested goods in Class 8 are mainly hand-operated tools and implements for the treatment of materials and for construction, repair and maintenance, and lifting tools. The contested goods in Class 9 are mainly apparatus, instruments and cables for electricity, measuring, detecting and monitoring instruments, indicators and controllers, surveying apparatus and instruments, and protective and safety equipment. The contested goods in Class 11 are mainly sanitary installations, water supply and sanitation equipment, igniters, industrial treatment installations, and heating, ventilating and air conditioning equipment. The contested goods in Class 12 are vehicles and conveyances, as well as parts and fittings for vehicles. The contested goods in Class 16 are mainly decoration and art materials and media, and bags or articles for packaging and wrapping. The contested goods in Class 17 are mainly finished or semi-finished goods, of materials included in this class. The contested goods in Class 18 are mainly bags and other carriers, as well as goods of leather. The contested goods in Class 19 are building and construction materials, structures and elements, not of metal, and unprocessed or semi-processed materials. The contested goods in Class 21 are mainly articles for cleaning, tableware and containers. The contested goods in Class 22 are mainly bags and sacks for packaging, storage and transport, ropes, slings and bands, nets, padding materials and other goods made of textile and fibres. The contested goods in Class 25 are mainly clothing, footwear and headgear. These goods have no sufficient connection with the opponent’s goods and services, which are essentially furniture and furnishings and goods (not included in other classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, pearl, meerschaum and substitutes for all these materials, or of plastics, in Class 20; advertising, business management, business administration and office functions in Class 35; and science and technology services, IT services and legal services in Class 42. These goods and services have different natures, purposes and methods of use. Moreover, they do not usually have the same commercial origin, distribution channels or end users. They are neither complementary nor in competition. Therefore, these goods and services are dissimilar.


Contested goods in Class 6


The contested metal hardware; hooks of metal for clothes rails; knobs of metal; hooks [metal hardware]; fittings of metal for furniture; furniture casters of metal are similar to the opponent’s furniture in Class 20 because these goods target the same public and may have the same distribution channels. Moreover, these goods are complementary.


The contested tool storage containers of metal [empty]; boxes of common metal; chests of metal; clothes hooks of metal; baskets of metal; tool boxes of metal, empty; tool chests of metal, empty; boxes for storage purposes [metal] are also similar to the opponent’s furniture in Class 20 because these goods target the same public and may have the same distribution channels.


The remaining contested goods are mainly nuts, bolts and fasteners of metal, locks and keys, containers, transportation and packaging articles of metal, pipes, tubes and hoses, and fittings therefor, including valves of metal, specific hardware of metal, building and construction materials and elements of metal, structures and transportable buildings of metal, unprocessed and semi-processed materials of metal, doors, gates, windows and window coverings of metal, and their parts and fittings. These goods and the opponent’s goods and services have different natures, purposes and methods of use. Moreover, they do not usually have the same commercial origin, distribution channels or end users. They are neither complementary nor in competition. Therefore, these goods and services are dissimilar.


Contested goods in Class 20


The contested storing boxes, not of metal; wooden storage boxes; shelves for storage; trestles [furniture]; office furniture; boxes of wood or plastic; shelves for file cabinets; furniture shelves; work benches; stools; tool chests, not of metal, empty; furniture; furniture of metal; racks [furniture]; shelving units; saw benches [furniture]; saw horses; cupboards; vice benches [furniture]; seats of metal; furniture for industrial use are identical to the opponent’s furniture, either because the goods are identically contained in both lists (including synonyms) or because the opponent’s goods include, are included in or overlap with the contested goods.


The contested mirrors (silvered glass); mirror tiles are included in the broad category of the opponent’s mirrors. Therefore, they are identical.


The contested keyboards for hanging keys are similar to a high degree to the opponent’s furniture because they have a comparable nature and may have the same purpose (to store things). They may also have the same producers, end users and distribution channels.


The contested moldings [mouldings] for picture frames are similar to the opponent’s picture frames because these goods are complementary and may have the same commercial origin and distribution channels.


The contested edgings of plastic for furniture; furniture fittings, not of metal; storage drawers [furniture]; curtain rings; curtain rails are similar to the opponent’s furniture because these goods have the same producers, end users and distribution channels. Moreover, they are complementary.


The contested picture frame brackets are similar to the opponent’s picture frames because these goods are complementary and may have the same providers, end users and distribution channels.


The remaining contested goods are mainly non-metallic fasteners, locks and keys, containers, closures and holders therefor, door, gate and window fittings, pallets, displays, valves, barrels and casks, ladders and movable steps and other specific items of non-metallic hardware. The contested goods and the opponent’s goods (not included in other classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, pearl, meerschaum and substitutes for all these materials, or of plastics have the same nature. Their purpose, in the broadest sense, may also be the same in that they may be used, for example, for fastening, for storage purposes, for construction purposes or to bridge vertical distances. To that extent these goods are similar to a low degree. However, in the absence of an express limitation by the opponent in order to clarify its goods, it cannot be assumed that they coincide in other criteria.


Contested goods in Class 27


The contested wallpaper; wallpaper of cork; wallpaper with a textile covering; non-textile wallpaper; floor coverings; vinyl floor coverings; linoleum; mats; textile wallpaper are similar to the opponent’s furniture because these goods coincide in purpose, end users and distribution channels.



  1. Relevant public — degree of attention


The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question.


In the present case, the goods found to be identical or similar to varying degrees are directed at the public at large and/or at business customers with specific professional knowledge or expertise.


The degree of attention is considered to be average.



  1. The signs




STIER



Earlier trade mark

The relevant territory is Romania.


The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components (11/11/1997, C‑251/95, Sabèl, EU:C:1997:528, § 23).


The verbal elements of the signs have no meaning for the relevant public and are, therefore, distinctive because they do not describe or allude to any characteristics of the relevant goods.


When signs consist of both verbal and figurative components, in principle, the verbal component of the sign usually has a stronger impact on the consumer than the figurative component. This is because the public does not tend to analyse signs and will more easily refer to the signs in question by their verbal element than by describing their figurative elements (14/07/2005, T‑312/03, Selenium-Ace, EU:T:2005:289, § 37).


Visually and aurally, the signs coincide in the letters ‘ST*ER’ and in their structure (words of five letters with the same sequence of consonants). However, they differ in their third letters, namely ‘A’ in the earlier mark and ‘I’ in the contested sign. Visually, the signs also differ in the blue and white colours of the earlier mark. However, the font used in the earlier mark is standard and does not constitute a real difference between the signs.


Therefore, the signs are visually and aurally similar to a high degree.


Conceptually, neither of the signs has a meaning for the public in the relevant territory. Since a conceptual comparison is not possible, the conceptual aspect does not influence the assessment of the similarity of the signs.


As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.



  1. Distinctiveness of the earlier mark


The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion.


According to the opponent, the earlier mark has been extensively used and enjoys an enhanced scope of protection. However, for reasons of procedural economy, the evidence filed by the opponent to prove this claim does not have to be assessed in the present case (see below in Global assessment’).


Consequently, the assessment of the distinctiveness of the earlier mark will rest on its distinctiveness per se. In the present case, the earlier trade mark as a whole has no meaning for any of the goods in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal.



  1. Global assessment, other arguments and conclusion


The appreciation of likelihood of confusion on the part of the public depends on numerous elements and, in particular, on the recognition of the earlier mark on the market, the association which can be made with the registered mark, the degree of similarity between the marks and between the goods or services identified. It must be appreciated globally, taking into account all factors relevant to the circumstances of the case (22/06/1999, C342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 18; 11/11/1997, C251/95, Sabèl, EU:C:1997:528, § 22).


The goods found to be identical or similar to varying degrees are directed at the public at large and/or at business customers; the degree of attention is considered average in relation to these goods.


Evaluating likelihood of confusion implies some interdependence between the relevant factors and, in particular, a similarity between the marks and between the goods or services. Therefore, a lesser degree of similarity between goods and services may be offset by a greater degree of similarity between the marks and vice versa (29/09/1998, C‑39/97, Canon, EU:C:1998:442, § 17).


The signs are visually and aurally similar to a high degree. As neither of the signs has a meaning for the relevant public, the conceptual aspect does not influence the assessment of the similarity of the signs


Account is taken of the fact that average consumers rarely have the chance to make a direct comparison between different marks, but must trust in their imperfect recollection of them (22/06/1999, C‑342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 26).


Considering all the above, the Opposition Division finds that there is a likelihood of confusion on the part of the public and therefore the opposition is partly well founded on the basis of the opponent’s Romanian trade mark registration No 68 433.


It follows from the above that the contested trade mark must be rejected for the goods found to be identical or similar to varying degrees to those of the earlier trade mark.


The rest of the contested goods are dissimilar. As similarity of goods and services is a necessary condition for the application of Article 8(1) EUTMR, the opposition based on this Article and directed at these goods cannot be successful.


Since the opposition is partially successful on the basis of the inherent distinctiveness of the earlier mark, there is no need to assess the enhanced degree of distinctiveness of the opposing mark due to its reputation as claimed by the opponent and in relation to identical and similar goods. The result would be the same even if the earlier mark enjoyed an enhanced degree of distinctiveness.


Likewise, there is no need to assess the claimed enhanced degree of distinctiveness of the opposing mark in relation to dissimilar goods, as the similarity of goods and services is a sine qua non for there to be likelihood of confusion. The result would be the same even if the earlier mark enjoyed an enhanced degree of distinctiveness.



REPUTATION — ARTICLE 8(5) EUTMR


According to Article 8(5) EUTMR, upon opposition by the proprietor of a registered earlier trade mark within the meaning of Article 8(2) EUTMR, the contested trade mark will not be registered where it is identical with, or similar to, an earlier trade mark, irrespective of whether the goods or services for which it is applied are identical with, similar to or not similar to those for which the earlier trade mark is registered, where, in the case of an earlier European Union trade mark, the trade mark has a reputation in the Union or, in the case of an earlier national trade mark, the trade mark has a reputation in the Member State concerned and where the use without due cause of the contested trade mark would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the earlier trade mark.


Therefore, the grounds for refusal of Article 8(5) EUTMR are only applicable when the following conditions are met.


  • The signs must be either identical or similar.


  • The opponent’s trade mark must have a reputation. The reputation must also be prior to the filing of the contested trade mark; it must exist in the territory concerned and for the goods and/or services on which the opposition is based.


  • Risk of injury: use of the contested trade mark would take unfair advantage of, or be detrimental to, the distinctive character or repute of the earlier trade mark.


The abovementioned requirements are cumulative and, therefore, the absence of any one of them will lead to the rejection of the opposition under Article 8(5) EUTMR (16/12/2010, T‑345/08 & T‑357/08, Botolist / Botocyl, EU:T:2010:529, § 41). However, the fulfilment of all the abovementioned conditions may not be sufficient. The opposition may still fail if the applicant establishes due cause for the use of the contested trade mark.



  1. Reputation of the earlier trade mark


According to the opponent, the earlier trade mark has a reputation in Romania.


Reputation implies a knowledge threshold that is reached only when the earlier mark is known by a significant part of the relevant public for the goods or services it covers. The relevant public is, depending on the goods or services marketed, either the public at large or a more specialised public.


In the present case, the contested trade mark was filed on 11/05/2017. Therefore, the opponent was required to prove that the trade mark on which the opposition is based had acquired a reputation in Romania prior to that date. The evidence must also show that the reputation was acquired for the goods for which the opponent has claimed reputation, namely:


Class 20: Furniture, mirrors, picture frames; goods (not included in other classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, pearl, meerschaum and substitutes for all these materials, or of plastics.


Class 35: Advertising; business management; business administration; office functions.


Class 42: Scientific and technological services and research and design relating thereto; industrial analysis and research services, creation and development of computer hardware and software; legal services.


The opposition is directed against all the remaining contested goods, namely all the contested goods in Classes 1, 2, 3, 4, 7, 8, 9, 11, 12, 16, 17, 18, 19, 21, 22, and 25 (listed above in the section on Article 8(1)(b) EUTMR) and the following goods in Class 6:

In order to determine the mark’s level of reputation, all the relevant facts of the case must be taken into consideration, including, in particular, the market share held by the trade mark, the intensity, geographical extent and duration of its use, and the size of the investment made by the undertaking in promoting it.


On 15/01/2018, the opponent submitted the following evidence:


Invoices (and translations into English) issued in 2012, 2013, 2014 and 2015. The sign ‘STAER’ appears at the top of the invoices in a central position.


An article in Romanian published on the website www.dailybusiness.ro on 27/01/2011 (with a translation into English), entitled ‘Staer furniture retailer opened a shop opposite the Steaua Stadium’.


Numerous photographs showing several shopfronts and trucks on which the mark ‘STAER’ is affixed. The sign ‘STAER’ is depicted alone or together with some Romanian words.


Photos of agendas, packaging, bags, brochures, business cards, flyers, pens and envelopes bearing the trade mark ‘STAER’.


Evidence that the domain name staer.ro has been reserved since 06/05/2003.


A copy of a document in Romanian and a translation of it into English containing information about the opponent and its activities. The source of the document is the Romanian Trade Register Office. It provides information about the opponent’s headquarters, outlets and authorised activities in Romania, for example construction, repair services, moving services, freight transport by road, financial activities, storage and retail sale of goods such as furniture, home furnishings, lighting equipment and household articles, manufacture of mattresses and providing furniture for kitchens. The opponent’s authorised activities also include the manufacture in Galati in Romania of mattresses and of furniture for kitchens, offices and shops.


The Opposition Division finds that the evidence submitted by the opponent does not demonstrate that the earlier trade mark acquired a reputation.


Despite showing some use of the trade mark, the evidence does not provide any indication of the degree of recognition of the trade mark by the relevant public. Furthermore, the evidence does not indicate the sales volumes, the market share of the trade mark or the extent to which the trade mark has been promoted. As a result, the evidence does not show that the trade mark is known by a significant part of the relevant public. Under these circumstances, the Opposition Division concludes that the opponent failed to prove that its trade mark has a reputation.


As seen above, it is a requirement for the opposition to be successful under Article 8(5) EUTMR that the earlier trade mark has a reputation. Since it has not been established that the earlier trade mark has a reputation, one of the necessary conditions contained in Article 8(5) EUTMR is not fulfilled, and the opposition must be rejected as far as this ground is concerned.


In any case, the Opposition Division also notes that the opponent did not provide any facts, arguments or evidence that could support the conclusion that the use of the contested trade mark would take unfair advantage of, or be detrimental to, the distinctive character or repute of the earlier trade mark.



COSTS


According to Article 109(1) EUTMR, the losing party in opposition proceedings must bear the fees and costs incurred by the other party. According to Article 109(3) EUTMR, where each party succeeds on some heads and fails on others, or if reasons of equity so dictate, the Opposition Division will decide a different apportionment of costs.


Since the opposition is successful for only some of the contested goods, both parties have succeeded on some heads and failed on others. Consequently, each party has to bear its own costs.

According to Article 67 EUTMR, any party adversely affected by this decision has a right to appeal against this decision. According to Article 68 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds for appeal must be filed within four months of the same date. The notice of appeal will be deemed to have been filed only when the appeal fee of EUR 720 has been paid.
