The Office raised an objection on 06/10/2017 pursuant to Article 7(1)(b) and (c) and Article 7(2) EUTMR because it found that the trade mark applied for is descriptive and devoid of any distinctive character, for the reasons set out in the attached letter.
The applicant failed to submit observations within the time limit. For the reasons set out in the letter of objection, and pursuant to Article 7(1)(b) and (c) and Article 7(2) EUTMR, the application for European Union trade mark No 17 146 911 is hereby rejected for the following services:
Class 41 Education; providing of training; entertainment; education services relating to fashion; organisation of fashion shows for entertainment purposes; organising and presenting displays of entertainment relating to style and fashion; university services; academic services provided by a university; vocational education services; further and higher education services; educational examination services; provision of courses of instruction; off-campus and distance learning courses; teaching, tuition and lecture services; awarding degrees and diplomas; library services; arranging, organising and conducting colloquiums, conferences, conventions, congresses, meetings, workshops, seminars and symposiums; publication of magazines, books, texts, scientific and research papers, and other printed matter; production of films, television programmes, and radio programmes; provision of recreational services and facilities; organisation of education, entertainment competitions; provision of information services in relation to management training; legal training services; legal educational services; provision of training services in relation to management; arranging, organising and conducting of entertainment events for charitable purposes; arranging, organising and conducting of educational events for charitable purposes; information, consultancy and advisory services relating to all of the aforesaid services.
The application will proceed accordingly for the following services:
Class 41 Sporting and cultural activities; provision of sports services and facilities; provision of art gallery facilities; provision of theatre services; sport competitions; provision of museum facilities; sports and fitness.
According to Article 67 EUTMR, you have a right to appeal against this decision. According to Article 68 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 720 has been paid.
