LIKELIHOOD OF CONFUSION — ARTICLE 8(1)(b) EUTMR
A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings. Whether a likelihood of confusion exists depends on the appreciation in a global assessment of several factors, which are interdependent. These factors include the similarity of the signs, the similarity of the goods and services, the distinctiveness of the earlier mark, the distinctive and dominant elements of the conflicting signs, and the relevant public.
The opposition is based on more than one earlier trade mark. The Opposition Division finds it appropriate to first examine the opposition in relation to the opponent’s Bulgarian trade mark registration No 91 439 for the word mark ‘DPASS’.
The goods and services
The goods and services on which the opposition is based are the following:

The contested goods and services are the following:
Class 9: Data processing equipment; computer software; image and sound carriers; magnetic data media; apparatus for making automatic financial transactions; automatic payment machines; encoded credit cards and bank cards; computer software applications, downloadable; application software for mobile communication apparatus, including mobile phones.
Class 35: Office functions in the collection, storage and processing of business and financial information and data.
Class 36: Electronic commerce payment services, namely, establishing funded accounts used to purchase goods and services on the Internet, electronic credit card transactions.
Class 42: Scientific and technological services and research and design relating thereto; design and development of computers, computer peripheral devices, computer systems, computer software, software applications, web applications and mobile applications; providing of computer software, software applications, web applications and mobile applications; including the aforesaid services being provided via electronic networks, including the internet and mobile communication means.
An interpretation of the wording of the list of goods and services is required to determine the scope of protection of these goods and services.
The term ‘including’, used in the applicant’s list of goods and services, indicates that the specific goods and services are only examples of items included in the category and that protection is not restricted to them. In other words, it introduces a non-exhaustive list of examples (09/04/2003, T‑224/01, Nu‑Tride, EU:T:2003:107).
However, the term ‘namely’, used in the opponent’s and the applicant’s list of goods and services to show the relationship of individual goods and services to a broader category, is exclusive and restricts the scope of protection only to the goods and services specifically listed.
As a further remark, it is to be noted that according to Article 33(7) EUTMR, goods or services are not regarded as being similar to or dissimilar from each other on the ground that they appear in the same or different classes under the Nice Classification.
The relevant factors relating to the comparison of the goods or services include, inter alia, the nature and purpose of the goods or services, the distribution channels, the sales outlets, the producers, the method of use and whether they are in competition with each other or complementary to each other.
Contested goods in Class 9
Data processing equipment; computer software; magnetic data media are identically contained in both lists of goods in Class 9 compared (including synonyms).
The contested image and sound carriers overlap with the opponent’s magnetic data carriers. Therefore, they are identical.
The contested apparatus for making automatic financial transactions and automatic payment machines are included in the broad category of the opponent’s data processing equipment. Therefore, they are identical.
The contested encoded credit cards and bank cards are included in the broad category of the opponent’s encoded card. Therefore, they are identical.
The contested computer software applications, downloadable and application software for mobile communication apparatus, including mobile phones are included in the broad category of the earlier computer software. Therefore, they are identical.
Contested services in Class 35
The contested office functions in the collection, storage and processing of business and financial information and data are the internal day-to-day operations of an organisation, including the administration and support services in the ‘back office’. They mainly cover activities that assist in the operation of a commercial enterprise and activities typical of secretarial services, such as shorthand and typing, compilation of information in computer databases, invoicing and administrative processing of purchase orders.
On the other hand, the opponent´s goods in Class 9 consist mainly of apparatus and instruments for scientific or research purposes, audiovisual and information technology equipment, as well as safety and life-saving equipment. The opponent’s services of Class 36 consist mainly of services rendered in financial and monetary affairs and services rendered in relation to insurance contracts of all kinds, and the ones in Class 42 include mainly services provided by persons in relation to the theoretical and practical aspects of complex fields of activities, for example, scientific laboratory services, engineering, or computer programming.
Therefore, the abovementioned contested services are dissimilar to all the opponent’s goods and services since they differ in purpose, distribution channels, providers and publics, and are neither complementary to nor in competition with each other.
Contested services in Class 36
The contested electronic commerce payment services, namely, establishing funded accounts used to purchase goods and services on the Internet, electronic credit card transactions are included in the broad category of the earlier financial affairs. Therefore, they are identical.
Contested services in Class 42
Scientific and technological services and research and design relating thereto; design and development of computer systems, computer software; including the aforesaid services being provided via electronic networks, including the internet and mobile communication means are identically contained in both lists of services (including synonyms).
The contested design and development of computers; including the aforesaid services being provided via electronic networks, including the internet and mobile communication means are included in the opponent’s broader category of design and development of computer hardware. Therefore, they are considered identical to the opponent’s services.
The contested design and development of software applications, web applications and mobile applications; including the aforesaid services being provided via electronic networks, including the internet and mobile communication means are included in the broad category of the opponent’s software design and development. Therefore, they are identical.
The contested providing of computer software, software applications, web applications and mobile applications; including the aforesaid services being provided via electronic networks, including the internet and mobile communication means include, as broader category, the opponent’s providing computer software that may be downloaded from a global computer network. Since the Opposition Division cannot dissect ex officio the broad category of the contested services, they are considered identical to the opponent’s services.
The contested design and development of computer peripheral devices; including the aforesaid services being provided via electronic networks, including the internet and mobile communication means are similar to the opponent´s design and development of computer hardware since they coincide in distribution channels/points of sale, can be directed at the same consumers and can originate from the same kind of undertakings.
Relevant public — degree of attention
The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question.
In the present case, the goods and services found to be identical or similar are directed at the public at large and also at business customers with specific professional knowledge or expertise (e.g. telecommunications engineers, researchers or IT experts). The degree of attention may vary from average to high because some of the goods and services are rather expensive and require a high degree of specialisation.

The relevant territory is Bulgaria.
The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components (11/11/1997, C - 251/95, Sabèl, EU:C:1997:528, § 23).
The contested figurative sign contains the verbal element ‘PASS’ depicted in capital black letters, slightly stylized. The letter 'P’ is open on the left side and the letter ‘A’ is formed by two chevrons pointing up, the one below being in red.
Neither the earlier word mark ‘DPASS’ nor the contested sign has a meaning for the relevant public and both are, therefore, distinctive for the relevant goods and services.
Visually and aurally, the signs coincide in the sequence of letters 'PASS' (and their sound) which constitutes the entire single verbal element of the contested sign and four out of five letters of the earlier mark. However, they differ in the first letter 'D' of this latter mark (and its sound).
At a visual level, they also differ in the stylisation of the contested sign. However, this stylisation is not particularly striking.
Therefore, the signs are visually and aurally similar to an average degree.
Conceptually, neither of the signs has a meaning for the public in the relevant territory. Since a conceptual comparison is not possible, the conceptual aspect does not influence the assessment of the similarity of the signs.
As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.
d) Distinctiveness of the earlier mark
The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion.
The opponent did not explicitly claim that its mark is particularly distinctive by virtue of intensive use or reputation.
Consequently, the assessment of the distinctiveness of the earlier mark will rest on its distinctiveness per se. In the present case, the earlier trade mark as a whole has no meaning for any of the goods and services in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal.
e) Global assessment, other arguments and conclusion
Likelihood of confusion covers situations where the consumer directly confuses the trade marks themselves, or where the consumer makes a connection between the conflicting signs and assumes that the goods/services covered are from the same or economically linked undertakings.
As has been concluded above, some of the contested goods and services are identical or similar to the opponent´s goods and services, and some others are dissimilar. The relevant public in relation to the goods and services found identical or similar is the public at large and business customers with specific professional knowledge or expertise (e.g. telecommunications engineers, researchers or IT experts). The degree of attention may vary from average to high.
The signs are visually and aurally similar to an average degree, while conceptually neither of them has a meaning for the Bulgarian public and, therefore, the conceptual aspect does not play any role in the assessment of the similarity of the signs. The distinctiveness of the earlier mark is normal.
Account is taken of the fact that average consumers rarely have the chance to make a direct comparison between different marks, but must trust in their imperfect recollection of them (22/06/1999, C‑342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 26). Even consumers who pay a high degree of attention to the goods and services in question, as was indicated in section b) of this decision, need to rely on their imperfect recollection of trade marks (21/11/2013, T‑443/12, ancotel, EU:T:2013:605, § 54).
In the present case, the signs under comparison share the letter string ‘-PASS’, which constitutes the whole of the verbal element of the contested sign, and differ in an additional letter ‘D-’ placed at the beginning of the earlier mark, as well as in the figurative aspects of the contested sign (of minor impact), differences that are not considered sufficient to exclude the risk of confusion in relation to identical or similar goods and services. The fact that the contested sign is wholly contained in the earlier mark, with just one different letter, is pivotal.
Considering all the above, the Opposition Division finds that there is a likelihood of confusion on the part of the Bulgarian public and therefore the opposition is partly well-founded on the basis of the opponent’s Bulgarian trade mark registration No 91 439.
It follows from the above that the contested trade mark must be rejected for the goods and services found to be identical or similar to those of the earlier trade mark.
The rest of the contested services are dissimilar. As similarity of goods and services is a necessary condition for the application of Article 8(1) EUTMR, the opposition based on this article and directed at these services cannot be successful.

opponent has also based its opposition on Bulgarian trade mark
registration No 91 440
for the figurative
mark
.
This earlier right
covers the same scope of goods and services as the mark already
compared. Therefore, the outcome cannot be different with respect to
the services for which the opposition has already been rejected; no
likelihood of confusion exists with respect to those services.
COSTS
According to Article 109(1) EUTMR, the losing party in opposition proceedings must bear the fees and costs incurred by the other party. According to Article 109(3) EUTMR, where each party succeeds on some heads and fails on others, or if reasons of equity so dictate, the Opposition Division will decide a different apportionment of costs.
Since the opposition is successful for only some of the contested goods and services, both parties have succeeded on some heads and failed on others. Consequently, each party has to bear its own costs.

According to Article 67 EUTMR, any party adversely affected by this decision has a right to appeal against this decision. According to Article 68 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds for appeal must be filed within four months of the same date. The notice of appeal will be deemed to have been filed only when the appeal fee of EUR 720 has been paid.
