The Office raised an objection on 30/09/2015 pursuant to Article 7(1) CTMR because it found that the trade mark applied for is devoid of distinctive character, for the reasons set out in the attached letter.


The applicant failed to submit observations within the time limit. For the reasons set out in the letter of objection, and pursuant to Article 7(1) CTMR, the application for Community trade mark No 14 464 705 is hereby rejected for the following services:


Class 39 Travel guide and travel information services; providing transport and travel information, including online; provision of tourist travel information; sightseeing [tourism]; providing information to tourists relating to excursions and sightseeing; travel arrangement; travel agency services; organisation of excursions, sightseeing tours, holidays, cruises, tours andtravel; package holiday services; arrangement of holiday travel and transportation by air, land and sea; cruise holiday reservation services; travel advice and escorting of travellers; online information, reservation and booking services in the tourism and business travel sector (online travel agencies); airport transfer services; car rental; provision of travel information; information, advice and consultancy in relation to all the aforesaid services.


Class 43 Providing travel lodging information services and travel lodging booking agency services for travellers; providing on-line information relating to holiday accommodation reservations; booking and reservation services for holiday accommodation; arranging of holiday accommodation; accommodation bureau services; providing room reservation and hotel reservation services; reservation services for booking meals; information, advice and consultancy in relation to all the aforesaid services.


The application is accepted for the remaining services.


According to Article 59 CTMR, you have a right to appeal this decision. According to Article 60 CTMR, notice of appeal must be filed in writing with the Office within two months of the date of notification of this decision. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 800 has been paid.
