On 02/02/16 you were informed that the mark applied for, GAMEDAY LIVE, was partially objectionable on the grounds of Article 7.1 (b) and (c) and 7.2 EUTMR, former CTMR (see attached letter)
No allegations have been received in this Office.
Consequently, in the light of the above, the mark applied for, GAMEDAY LIVE is refused in respect of the following services:
41 Entertainment services, namely, providing on-line computer, electronic and video games accessible via video game machines, mobile phones, tablets and computers; online entertainment in the nature of computer game tournaments; internet games (non-downloadable); providing online news and information in the field of computer games; entertainment services, namely, organising and conducting contests online; provision of computer games and video games for entertainment purposes; video game entertainment services; electronic publishing; publishing of computer game and electronic game software; providing a website featuring computer games and video games; information and advice relating to these services.
The application will be accepted for the remaining goods and services:
9 Computer software; video game software; electronic game software; interactive entertainment software; downloadable computer game, video game, electronic game and interactive entertainment software; electronic publications; software applications; website applications; mobile applications; interactive multi-media computer games; games software for use on consoles, mobile phones, tablets and other electronic devices.
42 Computer software development; design and development of computer games; computer programming of electronic and digital games; development of games for use on mobile phones, tablets and other electronic devices; design, development and maintenance of computer software and online games; information and advice relating to these services.
According to Article 59 EUTMR, you have a right to appeal against this decision. According to Article 60(1) EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 720 has been paid.
